Gov. Gary Herbert will call the Legislature into a special session next month to water down a bill that requires employers to use an electronic database to check employees' citizenship.
Herbert signed the bill into law on Wednesday, but said he hopes to revise the legislation before its July 1 effective date to clearly state that participation in the E-Verify system is entirely optional for one year.
Sen. Chris Buttars' bill originally sought to make the citizenship checks mandatory and included penalties for businesses that didn't comply. Those penalties were stripped out, but the bill still required the checks.
Business interests expressed concerns to Herbert about the impact of the requirement and the governor and Buttars agreed to rewrite the law to make clear participation in the E-Verify program would be strictly voluntary for 12 months.
After that, the participation would be mandatory, although there would still be no penalties for non-compliance.
"The governor had concerns about individual groups that maybe need a little more time to get used to the idea," Buttars said. "I don't want to hurt anybody. I just really believe we don't have an immigration problem; we have an evasion problem and it's got to be stopped, so I was open to that."
Herbert will call the Legislature into special session probably in May when the Legislature is scheduled to meet for its interim meetings, Buttars said.
"This bill achieves some very important goals, such as protecting young Utahns against identity theft," Herbert said. "My intent is simply to clarify that Utah's businesses are not mandated to participate in the E-Verify program."
Buttars said that the move toward E-Verify is a "big deal," and more than 2,000 employers are using the system, including The Church of Jesus Christ of Latter-day Saints and Costco.
"It's exciting because what this is going to do is ... with unemployment going up, it's going to give our people -- that is anybody who's legal -- the first shot at those jobs," Buttars said. "I think you're going to have a lot of states follow this."
