First victims of SB 81 – High Beam Violation in Utah County
SALT LAKE CITY— earlier today leaders of the Latino community held a meeting with the members of the Latino community to talk about the implications of SB81. The greatest concern to Latinos is whether local law enforcement officers and Sheriff Deputies would question anyone's legal status on a routine traffic stop.
Earlier this afternoon Tony Yapias (Proyecto Latino de Utah) received a phone call from family and friends of Doris George Torres and her 18 year old Downey Guevara George who were stopped for driving with a High Beam a traffic violation. The Sheriff Deputy (Unknown at this time) began to question the driver and passenger legal status. It's been reported that the Deputy then proceeded to make a phone call to an ICE Agent question Doris about her legal status. This traffic incident occurred between 4:45 AM to 5:00 in the Benjamin area (Utah County).
At about 4:30 PM this afternoon Proyecto Latino de Utah filed with the Utah Attorney General's office to open an investigation on this matter. Among the questions that have been submitted are:
1. Under what authority did this Sheriff Deputy have the right to question Doris and Downey's immigration status?
2. What are the internal policies of the Utah County Sheriff with regards to traffic violations and the undocumented?
3. Has Utah County Sheriff been certified by the US Homeland Security to the 287g program, if so how many deputies are currently trained.
4. The Sheriff Deputy in question repeatedly asked Doris (passenger) and Downey (Drive) their legal status. What is the official policy of the Utah County Sheriff with regards to the undocumented immigrants?
In addition we are calling for the immediate suspension of the Deputy in question pending this investigation.
The Latino community worst fear of SB81 has become a reality by the arrests of Doris and her son Downey. This incident in Utah County has broken any positive relationship the Utah County Sheriff's office may have had with the Latino community. Latinos are outraged by the abuse of power that it appears it may have happened.
In the mean time we will ask community organizations and request the ACLU to also investigate for possible civil rights violation.
