Nombramiento de magistrados en El Salvador con irregularidades.

El Secretariado Permanente de la Red Latinoamericana y del Caribe para la Democracia (Redlad) alerta sobre el nombramiento de funcionarios de segundo grado en El Salvador mediante atribuciones presuntamente no correspondidas.
En una sesión de la Asamblea Legislativa salvadoreña se negoció el nombramiento de diferentes funcionarios de segundo grado como Fiscal General, Magistrados y Tribunal de Ética, esto a pesar de que dicha labor le corresponde, según la ley, a los diputados recientemente electos y no a la Asamblea saliente (de mayoría oficialista), tal y como lo explica Claudia Umaña de la Fundación Democracia, Transparencia y Justicia (DTJ).
Organizaciones como la Asociación Nacional de la Empresa Privada (ANEP) han solicitado a la Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ) suspender los nombramientos realizados por la Asamblea Legislativa por considerarlos ilegales, la razón primordial expuesta es que se admite que dicha competencia es potestad de los parlamentarios electos al momento de asumir funciones tal y como ha sido siempre. Se argumenta además, que quedan vulnerados el principio de sincronía y el principio de legitimidad popular indirectas establecidos en la Constitución Política.
Las demandas presentadas ante la Sala de lo Constitucional indican que la elección magistrados, cuyas labores cesan el 30 de junio, no podían ser nombrados por la legislatura que finalizó el 30 de abril, ya que solamente se podía renovar un tercio de la Corte tal y como lo habían ya realizado los parlamentarios ahora salientes en el 2009.
Por ello, el Secretariado Permanente de la Red Latinoamericana y del Caribe para la Democracia (Redlad), plataforma de impulso a la democracia y los derechos humanos, integrada por más de 300 organizaciones de la región. Miembro Oficial del Foro de Sociedad Civil de la Organización de Estados Americanos (OEA) y Capítulo Regional del Movimiento Mundial por la Democracia (WMD):
· Se une con las organizaciones de la sociedad civil y ciudadanos en general que han solicitado una revisión de los casos. La democracia implica transparencia y apego a la ley.
· Hace un llamado a expertos constitucionalistas salvadoreños para que esgrimen sobre el caso y alerten ante posibles violaciones a la legislación salvadoreña.
· Insta al gobierno del Presidente Mauricio Funes, a los Señores Diputados y Diputadas y a la Sala de lo Constitucional a analizar detalladamente el caso y aplicar la legislación vigente sin el uso de vacíos legales que socaven la democracia que el país vive.
La elección de Magistrados, Fiscales Generales y Tribunal de Ética, debe hacerse de la forma más transparentemente posible con el fin de asegurar un ejercicio democrático donde todas las fuerzas políticas y sociales del país queden representadas de la mejor manera.

Appointment of judges in El Salvador with irregularities.

The Permanent Secretariat of Latin American and Caribbean Network for Democracy (Redlad) alert on the appointment of second-tier officials in El Salvador through supposed illegal attributions.
At a meeting of the Salvadoran Legislative Assembly negotiated the appointment of various officials of the second degree as Attorney General, Magistrates and Court of Ethics, this despite the fact that this work belongs, by law, the newly elected MPs and not Outgoing Assembly (government majority) as said Claudia Umaña of the Fundacion Democracia, Transparencia y Justicia (DTJ).
Organizations like the Asociación Nacional de la Empresa Privada (ANEP) have asked the Constitutional Chamber of the Supreme Court of Justice (CSJ) suspend the appointments made by the Legislature to consider illegal. The primary reason it is accepted that that power is the prerogative of new elected parliamentarians on taking functions. It is further argued, that the appointment act violate the principle of synchrony and the principle of indirect popular legitimacy established in the Constitution.
The demands presented to the Constitutional Chamber argue that the last legislature, which ended on April 30 during the three years could be renewed only one third of the Court, which had already made at the beginning of its work in 2009.
Therefore, the Permanent Secretariat of Latin American and Caribbean Network for Democracy (Redlad), a platform for advancing democracy and human rights, integrate over 300 organizations in the region. Official Member of the Civil Society Forum of the Organization of American States (OAS) and Regional Chapter of the World Movement for Democracy (WMD):
• Join with civil society organizations and citizens who have requested a review of cases. Democracy means transparency and adherence to the law.
• It calls for constitutional experts Salvadorans who wield the case and alert to possible violations of the laws of El Salvador.
• Urges the government of President Mauricio Funes, Members of Parliament and the Constitutional Chamber to analyze in detail the case and implement existing legislation without the use of legal loopholes that undermine the democracy that the country lives.
The election of Judges, Prosecutors General and Court of Ethics should be in the most transparently as possible in order to ensure a democratic exercise where all political and social forces of the country are represented in the best way.
